Business Career Services (BCS) advises all organizations of the legal considerations relative to unpaid internships.
When hiring unpaid interns, employers must keep in mind the legal ramifications. Unpaid internships in the U.S. are subject to scrutiny by the Department of Labor and the Courts. When offering an unpaid internship, employers are to review the guidelines in the US Department of Labor, Fair Labor Standards Act (FSLA), to ensure liability compliance. Regardless of the employer or type of work, it is imperative that the intern is the primary beneficiary of the role.
The Society for Human Resource Management (SHRM) also has also several articles on unpaid internships you may want to review.
If you have already determined that your unpaid internship passes the FSLA test, BCS invites you to post your internship on Handshake to reach all Daniels School of Business students.
We also encourage you to review the National Association of Colleges & Employer’s (NACE) position statement on unpaid internships as they seek to address the inherent inequities unpaid internships cause and to work to ensure all internships are paid.
